Terms of Service
for the Use of the Platform JoMoCo-Social Last Updated: January 2026 These Terms of Service ("Terms", "Conditions", "Agreement") govern the access and use of the software platform provided by JoMoCo-Solutions UG. By creating an account or using the platform, you agree to these Terms. If you do not agree to these Terms, you may not use the platform.
1. Parties to the Agreement This Agreement is between: JoMoCo-Solutions UG Email: info@jomoco-solutions.com ("we", "us", "JoMoCo-Solutions") and the user or the company they represent ("you", "your", "Client"). The platform is provided exclusively for business purposes. 2. Use of the Platform 2.1 Minimum Age and Authority You confirm that you are at least 18 years old and possess the legal authority to enter into contracts on behalf of your company. 2.2 Account Responsibility You are responsible for: The accuracy of your registration data The confidentiality of your login credentials Any use of your account, including by employees In the event of a security incident, you must inform us immediately via email. 2.3 Permitted and Prohibited Use You may only use the platform in compliance with the law, responsibly, and within the scope of this Agreement. Specifically prohibited are: Violations of legal regulations Spam, unauthorized advertising, mass communication without consent Deceptive, misleading, or unethical business practices Reverse engineering or manipulation of the platform Automated scraping, overloading, or disrupting the system Use to harm individuals or companies Transmission of illegal content We reserve the right to suspend or terminate accounts in case of violations. 2.4 Legal Obligations You bear sole responsibility for: Compliance with the GDPR and comparable data protection laws Correct management and documentation of your customer data Compliance with advertising, telecommunications, and consumer protection laws Compliance with tax regulations Industry or country-specific regulations JoMoCo-Solutions provides technical tools only and assumes no legal responsibility for your actions.
3. 3.3 Data Subject Rights You are responsible for fulfilling requests under GDPR, specifically: Information (Right to Access) Correction (Rectification) Deletion (Right to be Forgotten) Data portability Restriction of processing If we receive such requests, we will forward them to you. 3.4 Data Breaches In the event of data breaches on your side, you must: make the necessary notifications to authorities and data subjects take immediate measures document risks You indemnify JoMoCo-Solutions from claims arising from your non-compliance. 4. Payment Terms 4.1 Fees and Subscriptions All prices are transparently stated in the respective tariff. Subscriptions renew automatically unless you cancel in time. By using the platform, you authorize us to charge your payment method automatically. 4.2 Wallet / Credit If your account includes a credit account ("Wallet"): Fees for usage-based services are deducted automatically If your balance falls below a minimum amount, your payment method will be charged automatically Promotional credit has no cash value 4.3 Payment Default In case of missed payments, we may: suspend your account demand outstanding amounts pass on costs for return debits Billing disputes must be reported to info@jomoco-solutions.com within 30 days. 4.4 Termination / Cancellation You can cancel your subscription at any time via your account or by email. Fees already paid are generally not refundable unless required by law. 4.5 Taxes All fees are exclusive of statutory taxes. The responsibility for tax obligations lies with you. 5. Third-Party Services The platform may enable integrations with software or services from third parties. These are governed exclusively by the terms of use of the respective providers. JoMoCo-Solutions assumes no liability for: Functionality of external services Data protection violations by third parties Content or decisions of third parties Outages, limitations, or errors of external systems You are responsible for obtaining necessary consents from your clientele if you transfer data to third parties. 6. Availability, Changes, and Updates We strive to provide the platform in a stable and secure manner but cannot guarantee uninterrupted availability. We reserve the right to: Change features Update systems Adjust or discontinue services Changes to these Terms take effect upon publication. Continued use constitutes agreement. 7. Disclaimer The platform is provided "as is" and "as available". We provide no guarantees for: Fitness for a particular purpose Reliability Freedom from errors Compatibility with external systems Future availability of certain features JoMoCo-Solutions is not liable for: indirect or consequential damages lost profits data loss or unauthorized access damages caused by third parties misuse of the system by users Our liability is – to the extent legally permissible – limited to the amount you paid in the three months preceding the event of damage. 8. Indemnification You indemnify JoMoCo-Solutions from third-party claims arising from: unlawful use of the platform incorrect or impermissible communication to your customers data protection violations on your side violations of this Agreement legal violations by your company false information or misuse of the platform 9. Term and Termination This Agreement remains in effect as long as your account is active. We may suspend access or terminate for: Legal violations serious violations of these Terms continued payment default security risks misuse After termination, your data may be deleted after 90 days. 10. Governing Law and Dispute Resolution The laws of the Federal Republic of Germany shall apply. For all disputes, the place of jurisdiction is agreed to be the registered office of JoMoCo-Solutions UG, to the extent permissible. 11.
